These General Terms & Conditions ("Terms") apply to all services provided by AutoLuxFindUp ("Company," "we," "us") to its clients ("Client," "you") in the area of luxury vehicle curation, automotive consulting, and premium car sourcing services in Canada.
By engaging our services, whether through our website, in-person consultation, or telephone contact, you agree to be bound by these Terms. These Terms form the entire agreement between you and AutoLuxFindUp regarding the use of our automotive curation services.
Our services are exclusively directed towards professional automotive curation and are provided by qualified specialists with extensive expertise in luxury vehicle markets, classic automobiles, and premium automotive collection management.
2. Services
AutoLuxFindUp provides comprehensive luxury vehicle curation services including but not limited to:
2.1. Luxury Vehicle Sourcing: Locating and acquiring rare, classic, and luxury vehicles from verified dealers, private collectors, and exclusive automotive networks worldwide.
2.2. Classic Car Curation: Specialized services for vintage and classic automobiles including authentication, provenance verification, and condition assessment by certified automotive experts.
2.3. Premium Purchase Advisory: Comprehensive consultation services for high-value automotive acquisitions including market analysis, investment potential assessment, and negotiation support.
2.4. International Vehicle Import: Complete handling of international vehicle importation including customs clearance, compliance certification, and delivery coordination throughout Canada.
2.5. Concierge Service: White-glove automotive concierge services including vehicle transportation, storage coordination, maintenance scheduling, and exclusive event access.
2.6. Collection Strategy: Long-term automotive collection planning and portfolio development for discerning collectors and automotive enthusiasts.
All services are provided with the utmost discretion and professionalism, maintaining strict confidentiality regarding client preferences, transactions, and collection details.
3. Professional Standards and Qualifications
Our team consists of certified automotive specialists with extensive experience in luxury vehicle markets, classic car authentication, and premium automotive curation. We maintain the highest professional standards in all aspects of our service delivery.
All automotive assessments and recommendations are based on current market conditions, verified vehicle history, and comprehensive technical evaluations. While we exercise professional judgment and due diligence, we cannot guarantee future market performance or investment returns.
We adhere to all applicable Canadian regulations regarding vehicle importation, sales documentation, and consumer protection laws. Our services comply with provincial and federal automotive transaction requirements.
4. Client Responsibilities and Obligations
Clients are required to:
- Provide accurate and complete information regarding vehicle preferences, budget parameters, and specific requirements
- Respond promptly to requests for information or clarification regarding automotive searches and potential acquisitions
- Maintain adequate funding for desired vehicle acquisitions and associated costs including taxes, import duties, and transaction fees
- Comply with all applicable laws and regulations regarding vehicle ownership, registration, and operation
- Provide timely payment for services as outlined in service agreements
Clients must disclose any specific requirements, restrictions, or preferences that may affect our ability to provide optimal automotive curation services.
5. Fees and Payment Terms
5.1. Service Fees: Our fees are based on the complexity and scope of services required. Detailed fee structures are provided in individual service agreements.
5.2. Payment Schedule: Initial consultation fees are due upon scheduling. Retainer fees for ongoing curation services are payable upon agreement execution. Success fees for completed acquisitions are due upon transaction completion.
5.3. Additional Costs: Clients are responsible for all third-party costs including but not limited to vehicle inspections, transportation, insurance, import duties, taxes, and registration fees.
5.4. Payment Methods: We accept bank transfers, certified checks, and other approved payment methods. All payments must be in Canadian dollars unless otherwise agreed.
5.5. Late Payment: Late payment fees may apply to overdue accounts. We reserve the right to suspend services for accounts with outstanding balances.
6. Confidentiality and Non-Disclosure
We maintain strict confidentiality regarding all client information, vehicle preferences, transaction details, and collection strategies. This confidentiality extends to our network of dealers, collectors, and service providers.
Client information will not be shared with third parties except as necessary to provide requested services or as required by law. We implement comprehensive data protection measures to safeguard client privacy.
Clients similarly agree to maintain confidentiality regarding our methods, supplier networks, and proprietary processes used in vehicle curation services.
7. Limitation of Liability
7.1. Professional Services: Our liability is limited to the professional services we directly provide. We are not liable for the condition, performance, or future value of vehicles we assist in acquiring.
7.2. Third-Party Actions: We are not responsible for the actions or omissions of third parties including dealers, transporters, inspectors, or other service providers, although we exercise due diligence in their selection.
7.3. Maximum Liability: Our total liability for any claim is limited to the fees paid for the specific service giving rise to the claim.
7.4. Market Conditions: We are not liable for changes in market conditions, vehicle availability, or pricing that may affect transactions or acquisitions.
8. Refund Policy
8.1. Service Satisfaction Guarantee: We are committed to client satisfaction and will work diligently to address any concerns regarding our automotive curation services.
8.2. Consultation Fees: Initial consultation fees are non-refundable once the consultation has been provided, as our expert time and advice have been delivered.
8.3. Retainer Refunds: Unused portions of retainer fees may be refunded upon service termination, minus any costs incurred for work completed.
8.4. Success Fee Refunds: Success fees for completed vehicle acquisitions are non-refundable once the transaction has been finalized and the vehicle delivered.
8.5. Service Cancellation: Clients may cancel services with 30 days written notice. Refunds will be calculated based on work completed and costs incurred up to the cancellation date.
8.6. Dispute Resolution: Any refund disputes will be handled through our internal review process first, followed by mediation if necessary.
9. Intellectual Property
All proprietary methodologies, market analysis reports, vehicle evaluations, and collection strategies developed by AutoLuxFindUp remain our intellectual property. Clients receive non-exclusive rights to use information provided specifically for their automotive acquisitions.
Clients may not reproduce, distribute, or commercialize our proprietary processes, reports, or methodologies without express written consent.
10. Force Majeure
We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, trade restrictions, transportation disruptions, or global market conditions affecting automotive trade.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
12. Modifications and Updates
We reserve the right to modify these Terms as necessary to comply with legal requirements or improve our services. Material changes will be communicated to active clients through email notification or posted notices.
Continued use of our services after Terms modifications constitutes acceptance of the updated Terms.
